Credit Card EMI

By opting for any EMI Scheme, you hereby acknowledge and agree as follows:

  1. That the option of distributing the amount transacted by you (“Transaction Amount”) into equated monthly instalments (“EMIs”) can only be availed using the credit card of such banks which offer such an option. It is not available on transactions made using any other payment method.
  2. That the various EMI scheme options, including but not limited to different tenures, corresponding rate of interests and charges (“EMI Scheme(s)”) provided to you for distributing your Transaction Amount into EMIs are provided by banks for the credit cards issued by them and the merchant or the payment facilitator disclaims any liability or responsibility regarding the same. The banks may modify or revise any EMI Scheme at their sole discretion.
  3. That the full Transaction Amount shall be charged to your credit card at the time you make the transaction. You agree that the bank may take up to 4 days or more to convert the Transaction Amount into EMI. Thereafter, you get charged monthly EMI.
  4. That the conversion of the Transaction Amount into EMI as per the tenure and the rate of interest selected by you, is the sole discretion of the bank as per its internal policies and the merchant and the payment facilitator hereby disclaims any and all liability or responsibility regarding the same.
  5. That, in the event of cancellation of the transaction/return of the purchase, as per the cancellation/return/refund policy of the merchant, you shall get the refund of Transaction Amount, eligible to be refunded as per the refund policy of the merchant. Provided such refund shall not change the structure of the EMI. You further agree and acknowledge that the EMI closure shall be at the sole discretion of the bank as per the terms agreed between you and your bank, including but not limited to charging of any foreclosure charges or other charges by the bank. The merchant and the payment facilitator disclaims any and all liability or responsibility in this regard. The interest or taxes charged by the bank will be not refunded by Merchant or the payment facilitator.
  6. That the banks issuing the credit cards reserve the right to charge Goods and Services Tax (GST) or other applicable taxes on the Transaction Amount which are converted into EMIs.
  7. That the merchant or the payment facilitator has no role to play pertaining to the Credit Card including but not limited to its issuance, approval, any extension, pre-closure, or closure of any facility using the Credit Card and such matters are solely determined by the Bank.
  8. That your use of the credit card issued by your bank, is also governed by the terms and conditions of the agreement between you and your Bank.
  9. That all disputes between you and the bank, or, any query with regard to your credit card or the EMI Scheme opted by you, shall be addressed by your bank only and you hereby confirm to keep the merchant and the payment facilitator and their respective directors, employees completely indemnified in this regard. The merchant or the payment facilitator shall not be liable to mediate, resolve or address any dispute or disagreement between you and your Bank with regard to the credit card issued to you, or, with regard to the conversion of the transaction done by you into EMI.
  10. That the bank shall be solely responsible for recovering of any outstanding amount regarding the loan facility granted to you by the bank under the EMI Scheme. The merchant and the payment facilitator disclaims any and all liability or responsibility regarding the recovery/legal action initiated by the bank in case of delayed payment/non payment of any outstanding amount by you.
  11. You provide your unconditional, irrevocable and unequivocal consent and authorization to the merchant and the payment facilitator to share your information; including but not limited to your personal information, the Transaction Amount, the EMI Scheme selected by you, the EMI tenure and rate of interest selected by you; with your bank and you agree and understand that the same may be used by your bank for converting the Transaction Amount into EMI.
  12. You confirm that you have read and fully comprehended the various available EMI Schemes for conversion of your Transaction Amount into EMI, including but not limited to the total loan amount, Interest Rate, the EMI payable to the Bank and the loan tenure.
  13. HSBC Credit Card Holders: In addition to the T&Cs already captured, you agree to the Bank’s detailed T&C available at: : https://www.hsbc.co.in/credit-cards/features/instant-emi/
  14. For ICICI Bank, EMI facility is available only for retail credit cards.
  15. That by availing EMI option you will deemed to have accepted these EMI T&Cs.

Debit Card EMI

By opting for any EMI Scheme, you hereby acknowledge and agree as follows:

  1. That the option of distributing the amount transacted by you (“Transaction Amount”) into equated monthly instalments (“EMIs”) can only be availed using the debit card of such banks which offer such an option. It is not available on transactions made using any other payment method.
  2. That the various EMI scheme options, including but not limited to different tenures, corresponding rate of interests and charges (“EMI Scheme(s)”) provided to you for distributing your Transaction Amount into EMIs are provided by banks and the merchant and the payment facilitator disclaims any liability or responsibility regarding the same. The banks may modify or revise any EMI Scheme at their sole discretion.
  3. You don’t need to have the entire amount in your account at the time of transaction and bank will not block any amount on your card. We will use the pre-approved credit limit on your debit card enabled by your bank and bank will deduct the EMI amount every month from your account, if EMI is approved.
  4. That the conversion of the Transaction Amount into EMI as per the tenure and the rate of interest selected by you, is the sole discretion of the bank as per its internal policies and the merchant and the payment facilitator hereby disclaims any and all liability or responsibility regarding the same.
  5.   14. HDFC Debit Card Holders: In addition to T&Cs already captured, you agree to T&C mentioned in bank site.
  15. That by availing EMI option you will deemed to have accepted these EMI T&Cs.


TERMS AND CONDITIONS

DESCRIPTION OF ROADSIDE ASSISTANCE SERVICES

  1. Assistance over phone: In the event of the customers calling for support related to any vehicle problem, Roadside Assistance (RSA) partner shall understand the basic problem prior to offering solutions. Some minor, recurring issues can be supported over the phone and RSA partner shall try to resolve and guide customer for phone resolution.
  2. “On Site” Repair of the Vehicle: Should a vehicle be immobilized due to a mechanical breakdown only that could be repaired within 30 minutes and during the process of which there will not be disassembly or demolition of parts, RSA partner shall dispatch a technician or Service Provider, as the case may be, and bear transportation and labour costs.
  3. Replacement/ Locked or Lost Keys: In event that the Customer inadvertently locks himself out of the vehicle or loses or breaks his/her keys, RSA Partner will provide locksmith dispatch service. The Service Provider shall have the right to require the Customer to show his/her ID card, driver’s license and/or other proof of ownership of the vehicle before providing the service. If customer cannot provide the documents referred above or fails to authenticate the ownership of vehicle the Service Provider has the right to refuse to provide this service.
    Alternatively, RSA Partner can arrange to recuperate the spare key at a place designated by the Customer and deliver it to the place where the vehicle is immobilized. This service is limited to delivery within the same city, and the distance between the place that the spare keys stored, and the delivery location specified by the customer or the parking location of the vehicle is less than 50 KMs.
  4. Flat Tyre Support: If the Vehicle has punctured or burst tyre (s) or bolts or valve related issues, RSA Partner shall take care of changing it with the spare tyre carried in the customer’s vehicle. In a case where spare tyre cannot be used, service provider shall accompany the customer to the nearest tyre repair shop and back to vehicle. The customer shall have to pay directly to the tyre repair shop for repair and quality or workmanship. For vehicles stranded far away from relevant tyre repair shops we shall transfer the vehicle.
  5. Battery Jumpstart: In the event that the vehicle is immobilized because of battery problem, RSA Partner shall offer charging service to jumpstart the vehicle. Customer shall pay for any parts used during jump start.
  6. Fuel Delivery: In the event that the vehicle runs accidentally out of fuel, RSA Partner will deliver the necessary fuel (petrol or diesel) up to 5 litres of fuel can be delivered at the same time and the cost of delivery shall be free of charge, but the Customer shall pay for the cost of fuel to the Service Provider according to the price of petrol station of that day.
  7. Emergency Towing Assistance

  8. In case of Breakdown: In the event Vehicle suffers an immobilizing break down due to a mechanical or electrical fault which cannot be repaired on the spot, the customer will get the assistance in towing the vehicle to the nearest garage, using the best available towing mechanism.
  9. In case of an Accident: In the event, Vehicle suffers an immobilizing break down due to an accident, the customer will get the assistance in towing the vehicle to the nearest garage, using the appropriate towing mechanism.
  10. Towing in case of incorrect fueling: In the event vehicle being immobilized due to incorrect fuelling, the customer will get assistance in making the arrangement for the vehicle to be towed to the nearest garage using the appropriate towing mechanism.

    Other Towing Terms:

    • Distance covered under this program is 20km from incident location to the nearest garage. Additional KMs will be charged to customers on actual basis.
    • Towing will be done using best possible trucks available depending on the vehicle category.
    • In case the vehicle has met with an accident and RSA Partner feels that there is a possibility of damage / loss to any third party’s property / life, RSA Partner shall require the customer to arrange for a No Objection Certificate from the Police Station of the jurisdiction of accident spot.
    • Hydra-Large Crane: In case the vehicle has met with an accident and it is not possible to tow the vehicle using the winch / chain then recovery / loading of vehicle is done using additional support of Hydra / Large Crane. This shall be charged to customer on actuals.
  11. Customer conference calling: For seamless & speedy services a conference call (wherever required) between the customer, the assistance provider and itself will be arranged. Customer will be kept updated on the progress of intervention.
  12. Concierge Services:

    These benefits are applicable for customers saddled with unfortunate breakdown of the vehicle at an inconvenient distance away from home.

  13. SMS Relays/Emergency Message Service: In the event of breakdown or accident of the customer’s vehicle under RSA subscription, urgent messages will be relayed to a person of choice as required.
  14. Taxi Support: In the event where the vehicle is immobilized due to a breakdown (irrespective of the distance between incident location and registered address), the customer will get the assistance for arrangement of alternate mode of transport (taxi) to continue the journey or return to customer’s preferred location. Taxi service will be charged to the customer on actual basis.
  15. Hotel Accommodation: In the event vehicle is immobilized due to a breakdown, the customer will get the assistance in organizing for hotel accommodation near the location of the event. However, charges have to be borne by the customer on actual basis.
  16. Ambulance/Hospital Arrangement: In the event the vehicle meets with an accident or occupant of vehicle need ambulance for medical emergencies, customer will get assistance for an ambulance and hospital, if required. Customer will have to bear the cost related to this service.
  17. Medical Referral: In case of specific request received from customer about providing the contact details of the nearest medical facilities or clinics the same shall be provided. However, the quality of the medical services of the referred service providers cannot be guaranteed by the RSA Partner.
  18. Vehicle Repatriation: In case vehicle takes longer to repair and customer wants the repaired vehicle to be picked up from garage and dropped to his location, the same can be arranged for the customer on chargeable basis.
  19. Custody Services: In case customer is in hurry and does not want to wait for towing vehicle to arrive, customer can seek the custody services for vehicle. RSA Partner shall send its service provider to take custody of vehicle from customer and relieve him so that customer can carry on his journey.
  20. Luggage Transportation: In case customer needs to move his luggage from breakdown location to hotel during onward journey, RSA Partner shall arrange for the same.
  21. Hotel/House Call during Travel: In case customer needs a doctor visit at his home, for his family, in his absence or for himself while traveling, same can be arranged on customer’s request.
  22. Remote Location Evacuation: In case customer is stuck in a remote location and needs emergency evacuation, same can be arranged on customer’s request.
  23. Chauffer On-Demand: In case customer needs a chauffeur for any mobility requirements, RSA Partner will arrange for same on chargeable basis.
  24. Replacement / Courtesy Car: In case vehicle breakdown occurs at a location more than 100 km away from registered address and customer needs replacement vehicle for local mobility then replacement vehicle will be arranged on higher category or best available vehicle basis. This will be charged to customer on actual basis.

General Exclusions to the service coverages for Customers:

  1. Any event where breakdown is caused by deliberately inflicted damage, vandalism or participation in a criminal act or offence.
  2. Any event when the driver of the vehicle is found to be in any of the situations that are indicated below:
    • The state of intoxication or under the influence of drugs, toxins or narcotics not medically prescribed.
    • Lack of permission or corresponding license for the category of the vehicle or violation of the sanction of cancellation or withdrawal of them.
    • Those accidents resulting from the illegitimate removal of the vehicle.
    • Those accidents or breakdowns that are produced when the Customers infringed upon the regulatory ordinances as far as the requisites and number of persons transported, weight and means of things and animals that can be transported or the form of handling.
    • Those happening while the vehicle lacks documentation or requisites (including the Technical Inspection of the Vehicles and Obligatory Insurance) legally necessary to circulate on public roads in the country where the vehicle is found.
    • Any vehicle involved in or liable to be involved in legal case prior to or post immobilization.
    • Those caused by fuels, mineral essences, and other inflammable, explosive or toxic materials transported in the vehicle.
    • Any accident or breakdown caused due to usage of the car for racing, rally and criminal activity purposes.
    • Luggage that is not sufficiently wrapped or identified, fragile luggage or perishable products, and any commercial goods carried in the vehicle.
    • Any animals carried in the vehicle.
    • Damaged door glasses or non-functional windows when there are no security or weather risks.
    • Broken rear-view mirror not obstructing driver’s view.
    • Damaged or faulty external fuel cap but vehicle has sufficient fuel to reach the nearest authorized dealer.
    • Windscreen wipers turning faulty in fair weather or vehicle running out of windscreen wiper fluid.
    • Electronic Vehicle security system are faulty but do not render it immobilized and the alarm is not hooting continuously.

Description of Personal Accident Insurance

Coverage - Permanent Total Disablement (PTD) If at any time during the Policy Period, the Insured Person sustains an Injury resulting solely and directly due to an Accident anywhere in the world, and results in permanent total disablement (PTD), of any of the nature specified in the policy wordings, of the Insured person within 12 months of such accident, then the insurer shall pay the Insured Person or his/her nominee as the case may be, the lump sum amount as per table in the policy wordings. The benefit amount is calculated on the Sum Insured as specified in Policy schedule/ Certificate of Insurance against this cover.
Increase of Permanent Total Disablement (PTD) SI/ EMI protection In case of Permanent Total Disablement (PTD), if the insured person has an existing loan, the sum insured will get increased by amount equivalent to 3 EMIs, subject to maximum of Rs.15,000 per month.
Coverage - Permanent Partial Disablement (PPD) If at any time during the Policy Period, the Insured Person sustains an Injury resulting solely and directly due to an Accident anywhere in the world, and results in permanent partial disablement (PPD), of any of the nature specified in the policy wordings, of the Insured person within 12 months of such accident, then the insurer shall pay the Insured Person or his/her nominee as the case may be, the lump sum amount as per table mentioned in the policy wordings. The responsibility of sanction and the services for this facility shall be solely provided through respective banking partners.

Terms and conditions for the Tyre related services:

The tyre related services shall be performed by the Dealer himself using his expertise, workmanship and skills. The Dealer shall be solely responsible for to ensure the quality and proper performance of his services towards the customer.
